1. Seller

2. Scope
These Terms and Conditions of Sale govern all purchases of products made through the website and the online boutique of Franquette. By placing an order, the customer confirms that they have read and accepted these terms, which are available for download and storage at any time. Specific terms apply to memberships, events and catering, and to returns and cancellations.
3. Products and information
Product descriptions, photographs, weights, serving sizes, composition and allergen information are provided with care. Many products are handmade and may vary slightly in appearance. Customers with allergies or intolerances must review the allergen information for each product and contact us before ordering if in doubt; we cannot exclude cross-contamination unless expressly stated.
4. Prices and taxes
Prices are shown in euros and include Spanish VAT at the applicable rate, currently 10 % as a general rate unless otherwise indicated for a specific product. Delivery charges, where applicable, are shown before the order is confirmed. Member prices are available only to holders of an active membership. Discount codes are subject to their own conditions, cannot be combined unless stated, and may require a minimum order value.
5. Ordering process
Orders are placed by selecting products, choosing a fulfilment method, date and time, entering the required details, accepting these terms and completing payment. Orders must be placed at least 2 days before the chosen date and no more than 60 days in advance. Orders for the same day close at 18:00. Available dates and times may be limited by capacity. The contract is concluded when we send the order confirmation by email.
6. Payment
Payment is made by card through our secure payment service provider at the time of ordering. An order is confirmed only once payment has been successfully received. For company customers with an agreed invoice arrangement, payment is due within 14 days of the invoice date.
7. Fulfilment
Available fulfilment methods: collection at our premises. Collection takes place at Carrer de Santiago Rusiñol, 16, Centre, 07012 Palma de Mallorca, Illes Balears, Spain at the selected time. Where delivery is offered, it is made to the address provided within the selected time slot and delivery area. The customer must ensure someone is available to receive perishable products, which must be refrigerated and consumed as indicated.
8. Right of withdrawal
In accordance with Article 103 of the Spanish Consolidated Consumer Protection Law (Royal Legislative Decree 1/2007), the right of withdrawal does not apply to products that are perishable or may deteriorate or expire rapidly, to products made to the consumer's specifications or clearly personalised, or to sealed goods unsealed after delivery for health or hygiene reasons. For other products, consumers have fourteen days from delivery to withdraw, as set out in the Returns and Cancellation Policy.
9. Non-conforming products
If a product is defective, damaged or does not correspond to the order, the customer must inform us within 24 hours of receipt at franquette.mallorca@gmail.com, preferably with photographs. We will replace the product or refund the price, without prejudice to the consumer's statutory rights of conformity.
10. Liability
Franquette is not liable for failure to deliver caused by incorrect information provided by the customer, absence at the time of delivery or collection, or events beyond its reasonable control. Nothing in these terms limits liability that cannot be limited by law.
11. Complaints and disputes
Complaints may be sent to franquette.mallorca@gmail.com. Complaint forms are available to consumers upon request. Consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. These terms are governed by Spanish law; consumers may bring proceedings in the courts of their place of residence.
